Darlington County Magistrate

There are two Magistrate Court offices in Darlington County. The Darlington and Hartsville offices are open Monday through Friday from 8:30 am until 5:00 pm. 

Magistrates mainly handle traffic violations and criminal misdemeanors with a maximum fine of $500 or 30 days in jail. They also issue arrest warrants. Magistrates hear civil cases involving money up to $7,500. These cases can be over money owed others, defaulted credit payments and landlord-tenant disagreements.

If you need to see a magistrate pertaining to a criminal offense, which occurred in Darlington County, you must have the incident report number, which you have received, from the Sheriff's office. You will then contact the Magistrate in the township in which the offense occurred, requesting issuance of a criminal arrest warrant. If you are inquiring about a civil matter, then you must contact the Magistrate of the township in which the person resides.

After normal County business hours, a Magistrate is on call. However, the Magistrate on duty cannot issue warrants or legal papers on a crime that has just been committed unless the Magistrate has an incident report from the investigating police department.
